Multilateral Agreement M367

Under section 1.5.1 of Annex A of ADR concerning the carriage of articles containing gas in cryogenic receptacles

(1) By derogation from the provision in (3) (d) of packing instruction P006 in subsection 4.1.4.1 of ADR, articles containing gas in cryogenic receptacles capable of providing an equivalent level of protection as packing instruction P203 may be carried under the designation of UN 3538 ARTICLES CONTAINING NON-FLAMMABLE, NON-TOXIC GAS, N.O.S.

(2) The derogation is applicable under the following conditions:
a) Articles carried under this entry include large and robust articles containing open or closed cryogenic receptacles containing gas of Class 2, Classification code 6A.
b) The articles shall be able to withstand all conditions to which they will be subjected during normal conditions of carriage.
c) Cargo transport units including articles containing cryogenic receptacles containing a gas presenting a risk of asphyxiation shall comply with the provisions of 5.5.3 as appropriate.
d) The consignor shall enter in the transport document: “Carriage agreed according to section 1.5.1 of ADR (M367)”.

(3) This Agreement shall be valid until 31 December 2028 for carriage on the territories of those ADR Contracting Parties signatory to this Agreement. If is revoked before that date by one of the signatories, it shall remain valid until the above mentioned date only for carriage on the territories of those ADR Contracting Parties signatory to this Agreement which have been not revoked it.
