Multilateral Agreement M361 undersection 1.5.1 of ADR concerning the carriage of dangerous goods in used articles, machinery or apparatus

(1) The provisions of ADR do not have to be applied to used articles, machinery or apparatus that may be contaminated with dangerous goods on the inside if the following conditions are met:

a. The used articles, machinery or apparatus are carried for repair, inspection, maintenance, disposal or recycling.
b. Measures have been taken to ensure that the contents are safely enclosed and to prevent any leakage of contents under normal conditions of carriage.

(2) Used articles, machinery or apparatus that contain dangerous goods of Classes 1 and/or 7 shall be excluded from this Multilateral Agreement.

(3) A copy of this Agreement shall be carried on the transport unit.

(4) This Agreement shall be valid until 31 December 2026 for carriage on the territories of the ADR Contracting Parties signatory to this Agreement. If it is revoked before that date by one of the signatories, it shall remain valid until the above mentioned date only for carriage in the territories of those ADR Contracting Parties signatory to this Agreement which have not revoked it.
